1. Introduction

Welcome to Get Canna Card LLC (“Get Canna Card,” “we,” “our,” or “us”). Get Canna Card LLC is owned and operated by Med Card Services LLC, which provides administrative, technical, and communication support services for Get Canna Card.

These Terms of Use (“Terms”) govern your access to and use of our website, telehealth and consultation services, communication systems (including SMS and email), and related offerings (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

Nothing contained on this site or through the Services constitutes medical advice, diagnosis, or treatment. Any medical evaluation or recommendation is performed solely by licensed healthcare professionals in compliance with applicable state laws.

2. Eligibility

To use the Services, you must be at least 18 years old and capable of entering into a binding contract.

You represent and warrant that:

All information you provide to Get Canna Card is true, accurate, and complete;
You are a legal resident of a state that permits medical cannabis under its laws; and
You are accessing the Services only in compliance with all applicable federal, state, and local laws.

Get Canna Card’s Services are intended solely for residents of Utah, where medical cannabis use is legally authorized. We may request proof of age and residency (such as a valid, unexpired state-issued ID) to confirm your eligibility before any consultation is scheduled.

If you are under 18 years of age, you may only use the Services with the involvement and consent of a parent or legal guardian, and only where permitted by your state’s medical cannabis laws.

Get Canna Card reserves the right to deny or terminate access to any person or region where the Services may be unlawful or restricted.

3. Nature of Services

Get Canna Card LLC provides administrative and telehealth coordination services that facilitate access to licensed healthcare professionals through secure, HIPAA-compliant technologies supplied by third-party vendors (“Platform Partners”).

Get Canna Card itself does not practice medicine, provide medical advice, or issue medical cannabis recommendations. All medical consultations, evaluations, and treatment decisions are made solely by independent, licensed healthcare professionals in accordance with the laws of the state where the patient resides.

Get Canna Card does not cultivate, manufacture, distribute, or sell cannabis or any cannabis-related products, and it does not assist patients in obtaining cannabis in any form. Its role is strictly limited to facilitating telehealth evaluations, scheduling, communication, and related administrative functions.

Use of the Services does not create a doctor-patient relationship between you and Get Canna Card. Any doctor-patient relationship that may arise is exclusively between you and the licensed healthcare professional who provides your consultation.

4.2 Scope of Services

Get Canna Card LLC does not cultivate, manufacture, distribute, or sell cannabis or cannabis-related products, nor does it assist patients in obtaining cannabis in any form. The Services are limited to facilitating telehealth evaluations, educational resources, and administrative coordination for potential medical cannabis recommendations where permitted by state law.

4.3 Provider Discretion and No Guarantee

Medical cannabis recommendations are issued solely at the discretion of licensed healthcare providers. Get Canna Card LLC does not guarantee that any patient will receive a recommendation or approval for medical cannabis. Payment for Services covers only the professional evaluation and administrative coordination; it does not guarantee issuance of a recommendation.

4.4 Residency Requirements

Patients must be legal residents of a U.S. state or jurisdiction where medical cannabis use is authorized under applicable law. Proof of residency (such as a valid, non-expired state-issued ID) may be required before scheduling a consultation.

4.5 No Guarantee of Efficacy

Neither Get Canna Card LLC nor its affiliated healthcare providers guarantee that medical cannabis will be an effective treatment for any medical condition. The potential benefits and risks of medical cannabis should be discussed directly with a qualified healthcare professional.

4.6 Acknowledgement of Legal Conflicts

You understand that medical cannabis laws vary by jurisdiction and that federal law may conflict with your state’s medical cannabis program. By using the Services, you acknowledge this conflict and assume all risks associated with the use of medical cannabis.

5. Medical Disclaimers

Telehealth consultations accessed through Get Canna Card are provided exclusively by licensed healthcare professionals where permitted by law. These providers operate independently of Get Canna Card LLC and are solely responsible for all medical decisions, advice, diagnoses, and treatments provided to patients.

Get Canna Card LLC does not practice medicine, provide medical advice, or guarantee the accuracy, adequacy, or outcomes of any evaluation or recommendation. Any information made available through the Services—including website content, educational resources, or communications—is provided for informational purposes only and should not be considered medical advice or a substitute for in-person professional care.

Get Canna Card makes no guarantee that any user will qualify for or receive a medical cannabis recommendation or that medical cannabis will improve any condition or symptom.

Users are solely responsible for determining whether use of medical cannabis is lawful in their jurisdiction and for complying with all applicable laws before seeking or using cannabis in any form.

6. User Accounts

You may be required to create a user account to access certain features of the Services, including scheduling, payment, and communication with licensed providers.

When creating an account, you agree to:

Provide accurate, current, and complete information;
Maintain the confidentiality of your login credentials; and
Accept responsibility for all activities that occur under your account.

You agree not to share your login credentials with any other person or entity and to notify Get Canna Card immediately of any unauthorized use or security breach involving your account.

Get Canna Card reserves the right to suspend or terminate your account at any time, with or without notice, if it believes you have violated these Terms, provided false information, engaged in unlawful conduct, or otherwise acted in a manner inconsistent with the intended use of the Services.

Accounts created for fraudulent or deceptive purposes may be reported to law enforcement or regulatory authorities as required by law.

7. Consent to Communications and SMS Messages

By providing your phone number, email address, or other contact information, you consent to receive communications from Get Canna Card LLC and its administrative service provider, Med Card Services LLC, including —but not limited to — appointment reminders, account updates, follow-ups, and marketing or educational messages.

These communications may be delivered via text (SMS/MMS), phone call, email, or automated system. Message frequency may vary. Standard message and data rates may apply.

You may opt out of promotional or marketing messages at any time by replying STOP to a text message or following the unsubscribe instructions in an email. Transactional or service-related messages essential to your care or account may continue even after you opt out of marketing messages.

All communications are sent through secure systems owned and operated by Med Card Services LLC on behalf of Get Canna Card. Med Card Services acts solely as a business associate under HIPAA and does not engage in the practice of medicine. All messages and data transmissions comply with HIPAA and applicable privacy laws.

If you disable or block required communications, certain features or portions of the Services may become unavailable.

8. Third-Party Platforms and Service Providers

Get Canna Card LLC partners with independent telehealth, technology, and payment vendors (“Platform Partners”) to deliver certain aspects of the Services, including scheduling, video consultation, secure messaging, and payment processing.

Get Canna Card may share limited personal or health-related information with these partners as needed to provide or support the Services. Each partner is contractually required to protect your information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and other applicable privacy and data-security laws.

Get Canna Card is not responsible for the actions, omissions, or content of any third-party platform, nor does it control or endorse the policies or practices of those partners. Your use of third-party platforms and services may be subject to separate terms, privacy policies, and data-use practices beyond Get Canna Card’s control.

Get Canna Card and Med Card Services LLC make reasonable efforts to partner only with reputable, compliant vendors but cannot guarantee the security or performance of systems operated by third parties. You acknowledge and agree that your use of such third-party services is at your own risk.

9. Payments and Billing

All fees and payment terms for Get Canna Card’s Services are displayed at the time of scheduling or purchase. By submitting payment information, you authorize Get Canna Card LLC (and its administrative provider, Med Card Services LLC) to charge the indicated amount to your chosen payment method for the applicable Services.

All fees are non-refundable, except as required by law or expressly stated otherwise in writing by Get Canna Card. Payments cover the medical evaluation and administrative coordination only and do not guarantee issuance of a medical cannabis recommendation or approval by a healthcare provider.

Payments are processed through secure third-party payment processors that comply with PCI DSS and other industry security standards. Get Canna Card does not store or retain your full payment card details.

In the event of a billing error or duplicate charge, please contact privacy@medcardservices.co within seven (7) days of the transaction so we can investigate and, if applicable, issue a correction or refund.

Get Canna Card reserves the right to change its fees or billing practices at any time. Any new or revised fees will be effective upon posting to the website unless otherwise stated. Continued use of the Services after such changes constitutes your acceptance of the updated terms.

10. Privacy and Data Use

Get Canna Card LLC is committed to protecting your privacy and complying with the Health Insurance Portability and Accountability Act (HIPAA), state privacy laws, and other applicable regulations governing the confidentiality of medical information.

By using the Services, you consent to the collection, use, and sharing of your personal and health-related information as described in our Privacy Policy. This may include information such as your name, contact details, demographic data, medical history, consultation notes, and communications with healthcare providers.

Get Canna Card may share your information with licensed healthcare professionals and third-party vendors solely for the purpose of delivering the Services, processing payments, and maintaining secure communication systems.

All electronic communications, scheduling systems, and data storage platforms are managed through secure, HIPAA-compliant systems operated by Med Card Services LLC on behalf of Get Canna Card. Med Card Services acts solely as a Business Associate under HIPAA and is bound by contractual and legal obligations to safeguard your information, maintain confidentiality, and use data only as permitted by law.

Get Canna Card does not sell, rent, or exchange personal health information for marketing purposes. Your data will only be disclosed when required by law (such as a subpoena or public-health reporting obligation) or as otherwise authorized by you in writing.

You are responsible for maintaining the confidentiality of any communications or documentation you receive from Get Canna Card and for safeguarding your devices and login credentials against unauthorized access.

11. User Responsibilities

By using the Services, you agree to use them only for lawful and legitimate purposes and in accordance with these Terms. You further agree not to engage in conduct that could harm, disrupt, or misrepresent Get Canna Card LLC, its healthcare providers, or any other users.

Specifically, you agree not to:

Provide false, misleading, or incomplete information during registration, evaluation, or communication with healthcare providers;
Attempt to obtain a medical cannabis recommendation through fraud, misrepresentation, or by impersonating another person;
Use the Services to promote, distribute, or sell cannabis or cannabis products;
Interfere with or disrupt the operation of the website, platform, or communication systems;
Attempt to access another user’s account or any data not intended for you;
Use automated systems, bots, or data-mining tools to extract or reproduce information from the site; or
Violate any applicable federal, state, or local laws or regulations in connection with your use of the Services.

You are solely responsible for ensuring that your use of the Services complies with all applicable laws in your jurisdiction.

Get Canna Card reserves the right to deny, suspend, or terminate access to the Services at its discretion if it determines that a user has violated these Terms, engaged in fraudulent activity, or otherwise abused the platform.

12. Intellectual Property

All content and materials available through the Services—including, but not limited to, text, graphics, images, logos, icons, videos, software, audio clips, code, design elements, and other digital assets—are the exclusive property of Get Canna Card LLC, its affiliates, or its licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

The names, logos, and trademarks associated with Get Canna Card, Med Card Services, and any affiliated clinics or service brands may not be used without express written permission. All rights not expressly granted under these Terms are reserved by Get Canna Card and its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.

You may not:

Copy, reproduce, modify, distribute, or publicly display any content from the Services without prior written consent;
Reverse-engineer, decompile, or disassemble any software or code associated with the Services;
Remove or alter any copyright, trademark, or proprietary notice; or
Use the Services or any portion of their content for commercial purposes without authorization.

Unauthorized use of Get Canna Card’s intellectual property may result in termination of your access and potential civil or criminal liability under applicable law.

13. No Warranties

The Services, including all content, functionality, and communications provided through Get Canna Card LLC or Med Card Services LLC, are offered on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, Get Canna Card and its affiliates disclaim all warranties, express or implied, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Get Canna Card does not warrant or guarantee that:

The Services will be uninterrupted, timely, secure, or error-free;
Any information or content provided through the Services will be accurate, complete, or reliable; or
Any defects or errors will be corrected.

Get Canna Card does not guarantee the outcome of any medical evaluation, recommendation, or treatment provided by a licensed healthcare professional using the platform. All medical services are performed solely at the discretion of the independent provider.

Users assume full responsibility for their use of the Services, including reliance on any information or materials obtained through Get Canna Card.

14. Limitation of Liability

To the maximum extent permitted by applicable law, neither Get Canna Card LLC, Med Card Services LLC, nor their respective affiliates, officers, employees, contractors, or agents shall be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages of any kind, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Services.

Without limiting the foregoing, Get Canna Card and Med Card Services are not responsible for:

Any decision or medical judgment made by a licensed healthcare professional using the platform;
Any interruption or delay in service due to technical, maintenance, or network issues;
Unauthorized access to or alteration of your transmissions or data; or
Any damages arising from your reliance on information or recommendations obtained through the Services.

Get Canna Card’s and Med Card Services’ total liability for any claim arising out of or related to these Terms or your use of the Services, regardless of the form of action, shall not exceed the amount you paid, if any, for the Services that gave rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this limitation may not apply to you. In such cases, Get Canna Card’s liability will be limited to the fullest extent permitted by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Get Canna Card LLC, Med Card Services LLC, their respective affiliates, subsidiaries, officers, directors, employees, contractors, licensors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

Your access to or use of the Services;
Your violation of these Terms or any applicable law or regulation;
Any information, content, or materials you submit or transmit through the Services;
Any interaction between you and a licensed healthcare provider accessed via the Services; or
Your negligent, reckless, or intentionally wrongful conduct.

Get Canna Card reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate fully with Get Canna Card in asserting any available defenses.

This obligation will survive termination or expiration of these Terms and your use of the Services.

16. Governing Law and Jurisdiction

These Terms and any dispute, claim, or controversy arising out of or related to your use of the Services shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict-of-law principles.

You agree that the state and federal courts located in Salt Lake County, Utah shall have exclusive jurisdiction over any legal proceedings arising out of or related to these Terms or your use of the Services, except as otherwise provided in Section 17 (Dispute Resolution and Binding Arbitration).

You are solely responsible for ensuring that your use of the Services complies with the laws of your jurisdiction. If you access the Services from outside a state or territory where medical cannabis is legal, you do so at your own risk.

Nothing in this section limits Get Canna Card’s right to seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

17. Dispute Resolution and Binding Arbitration

Good-Faith Resolution

Before initiating any formal dispute resolution process, you agree to first attempt to resolve any concern, complaint, or dispute with Get Canna Card LLC in good faith by contacting us at privacy@medcardservices.co and providing a written description of the issue. Both parties agree to make reasonable efforts to resolve the matter informally within thirty (30) days.

Binding Arbitration Agreement

If a dispute cannot be resolved informally, you and Get Canna Card LLC (including its affiliates, officers, and agents) agree that any claim, controversy, or dispute arising out of or relating to these Terms or your use of the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Arbitration shall take place in Salt Lake City, Utah, before a single neutral arbitrator. Judgment on the arbitration award may be entered in any court having jurisdiction.

Each party shall bear its own attorneys’ fees and costs, unless the arbitrator determines that an award of fees or costs is appropriate under applicable law.

Class Action Waiver

You agree that any arbitration or legal proceeding will be conducted solely on an individual basis, and that you will not seek to have any claim heard as a class action, representative action, or collective action. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.

Exceptions to Arbitration

Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction in Salt Lake County, Utah to protect its intellectual property rights, trade secrets, or confidential information, pending completion of the arbitration.

Waiver of Jury Trial

You acknowledge and agree that by accepting these Terms, you and Get Canna Card LLC are each waiving the right to a trial by jury in any dispute to the maximum extent permitted by law.

18. Termination

Get Canna Card LLC reserves the right to suspend or terminate your access to the Services at any time, with or without notice, if it determines that you have:

Violated these Terms or any applicable law or regulation;
Provided false or misleading information;
Misused the Services, including attempting to obtain or use a medical cannabis recommendation fraudulently; or
Engaged in conduct that may harm Get Canna Card, Med Card Services, affiliated providers, or other users.

You may terminate your account at any time by contacting us at privacy@medcardservices.co. Upon termination, your right to access and use the Services will immediately cease.

Get Canna Card may retain certain information as required by law, regulation, or HIPAA compliance, including medical records, communications, or transaction details. Any ongoing obligations or rights that, by their nature, should survive termination—such as those related to indemnification, limitation of liability, dispute resolution, and intellectual property—will continue in full force and effect.

Get Canna Card shall not be liable to you or any third party for suspension or termination of access to the Services.

19. Changes to These Terms

Get Canna Card LLC may update or modify these Terms of Use at any time to reflect changes in laws, regulations, business practices, or technology. The “Last Updated” date at the top of this page indicates the most recent revision.

Any updates or modifications will become effective immediately upon posting to the website, unless otherwise specified. By continuing to access or use the Services after such changes are posted, you agree to be bound by the revised Terms.

Get Canna Card encourages users to review these Terms periodically to remain informed of their rights and obligations. If a material change affects your legal rights or obligations, Get Canna Card may, at its discretion, provide notice through email, SMS, or a prominent notice on the website.

Your continued use of the Services following any update constitutes your acceptance of the revised Terms.
